1. Introduction and Definitions

1.1. This website, www.lepetitdepot.com ("Website"), is owned and operated by Le Petit Depot Pte. Ltd. ("we", "us", "our", or the "Company"), a company incorporated in Singapore under registration number 201229261K.

1.2. "You" or "Customer" refers to any individual or entity placing an order on the Website.

1.3. "Goods" means the products ordered by you through the Website.

1.4. "Price" means the total cost of Goods, inclusive of Goods and Services Tax (GST) as we are a GST-registered company. Delivery charges are separate (see Section 3.5).

1.5. "Order" means the purchase request submitted by you via the Website.

1.6. These Terms and Conditions ("Terms") govern all purchases made on the Website and form a legally binding contract between you and Le Petit Depot Pte. Ltd.

1.7. We may update these Terms from time to time. The updated Terms will be posted on the Website with the "Last Updated" date. By placing an order after changes are published, you agree to be bound by the updated Terms. We recommend reviewing the Terms before each order.

1.8. These Terms are governed by the laws of Singapore, and any disputes will be subject to the exclusive jurisdiction of the Singapore courts.

2. Registration

2.1. To place an order, you must be at least 16 years old and complete the registration process. Individuals under 16 are not permitted to register or submit personal information. If we discover that a person under 16 has registered, we will promptly delete their information. Please notify us at customerservice@phoonhuat.com if you become aware of such a case.

2.2. During registration, you must provide accurate details, including your full name, email address, delivery address, and telephone number. Additional information may be requested to facilitate delivery.

2.3. You must update your account details in the “My Account” section of the Website before placing an order if any information changes (e.g., address or contact details).

2.4. You will select a password during registration. This password is confidential, and you are responsible for keeping it secure. Notify us immediately at customerservice@phoonhuat.com if you suspect unauthorized use of your account.

2.5. We reserve the right to suspend or terminate accounts for misuse, fraud, or non-compliance with these Terms.

3. Prices and Delivery Charges

3.1. The Price of Goods is as quoted on the Website at the time you confirm your order by clicking the “Purchase” button, subject to correction of any inadvertent technical errors (e.g., pricing mistakes). We will notify you promptly if such an error occurs and offer you the option to proceed at the correct price or cancel the order.

3.2. Prices for repeat or duplicate orders will be based on the prices displayed at the time the new order is confirmed.

3.3. Promotional prices are valid for a limited period. Prices may increase significantly once promotions end.

3.4. Price Lock Guarantee: We guarantee that our prices are equal to or lower than those of comparable online grocery retailers in Singapore for the same or similar products, based on unit price and comparable quality. Price Lock does not apply to promotional offers by other retailers, clearance sales, or bulk discounts. We reserve the right to amend or discontinue the Price Lock offer or individual items at any time. All products are subject to availability.

3.5. There is no minimum order quantity or amount.

3.6. Delivery charges are separate from the Price of Goods. A delivery fee of SGD 8 applies to orders of SGD 100 or less. Orders above SGD 100 qualify for free delivery. Delivery charges will be clearly displayed at checkout.

4. Purchase Contract

4.1. By placing an order, you agree to purchase Goods for personal use only and not for resale or commercial distribution.

4.2. An order is placed when you tick the “I Accept the Terms and Conditions” box at checkout and submit payment.

4.3. We will confirm acceptance of your order by sending a confirmation email to the email address provided. A binding contract is formed only upon our confirmation. We reserve the right to reject an order (e.g., due to stock unavailability or suspected fraud).

4.4. If we cannot accept your order, we will notify you promptly and refund any payment made.

5. Payment

5.1. Payment must be completed for an order to be confirmed. The total amount, including the Price of Goods and any delivery charges, will be displayed at checkout and on the invoice provided with your delivery.

5.2. Payments are processed securely via PayPal or other payment gateways available on the Website (e.g., credit/debit cards). You must provide valid payment details.

5.3. There is no minimum order requirement for payment.

5.4. In case of payment disputes, please contact us at customerservice@phoonhuat.com. We comply with the Consumer Protection (Fair Trading) Act and will resolve disputes fairly.

6. Deliveries

6.1. We deliver to all areas in Singapore, subject to our delivery subcontractor’s coverage.

6.2. Delivery will be made to the address specified in your account or provided at checkout. You are responsible for ensuring the accuracy of delivery details. To update the delivery address contact us at +65 8318 9282 or email sales@lepetitdepot.com quoting your order tracking number.

6.3. Goods are subject to availability, especially seasonal or perishable items. If an item is unavailable, we will notify you and offer a replacement, voucher, or refund (see Section 10).

6.4. We aim to deliver the full quantity ordered. If the delivery is incomplete or includes incorrect Goods, notify us within 48 hours at sales@lepetitdepot.com. Our liability is limited to the Price of the affected Goods.

6.5. You must ensure an authorized person is available at the delivery address during the selected delivery slot. If no one is available, contact us at +65 8318 9282, quoting your order tracking number, to reschedule within 3 calendar days. If delivery fails due to your absence, we may charge the full cost of perishable items.

6.6. The recipient must inspect the Goods upon delivery. By signing for the delivery, you (or an authorized representative) confirm the Goods are received in good condition, unless otherwise noted.

6.7. For alcohol deliveries, the recipient must be 19 or older and may be required to present a valid photo ID to verify age, in compliance with Singapore’s Liquor Control (Supply and Consumption) Act.

6.8. We are not liable for loss or damage to Goods after delivery is completed or due to your failure to provide accurate delivery instructions.

6.9. We reserve the right to modify delivery areas or schedules and will notify you of any changes affecting your order.

6.10. In cases of force majeure (e.g., extreme weather, government restrictions), we may delay or cancel deliveries. We will contact you to reschedule, and our liability is limited to the Price of undelivered Goods.

7. Amendments, Returns, and Cancellations

7.1. Orders cannot be amended or canceled once payment is confirmed, except as provided below.

7.2. Faulty or Incorrect Goods: If Goods are faulty, damaged, or incorrect upon delivery, you may return them to the driver or notify us within 48 hours at customerservice@phoonhuat.com. We will arrange a replacement, issue a voucher, or provide a full refund, subject to inspection and return of the Goods in their original packaging.

7.3. Consumer Rights: Under the Consumer Protection (Fair Trading) Act, you may be entitled to remedies for defective Goods or non-conformity with the contract. Contact us to discuss your options.

7.4. Cooling-Off Period: For online purchases, you have a 7-day cooling-off period to cancel certain orders (excluding perishable Goods or Goods made to your specifications) under the CPFTA, starting from the date of delivery. To cancel, email customerservice@phoonhuat.com. You are responsible for return shipping costs, and Goods must be unused and in original packaging. Refunds will be processed within 14 days of receiving the returned Goods.

7.5. We reserve the right to refuse returns or refunds for Goods damaged due to improper handling by you.

8. Warranties and Liability

8.1. Goods are warranted to be of satisfactory quality and fit for their described purpose, as required by the Sale of Goods Act. If Goods do not meet these standards, you are entitled to remedies under Section 7.

8.2. To the maximum extent permitted by law, our liability for any claim arising from these Terms, the Website, or your order is limited to the Price of the affected Goods. We are not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, whether in contract, tort, or otherwise.

8.3. We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, technical failures). In such cases, we will notify you and offer reasonable remedies (e.g., rescheduling delivery or refund).

8.4. Nothing in these Terms excludes or limits our liability for death, personal injury, fraud, or any liability that cannot be excluded under Singapore law.

9. Personal Data

9.1. We collect and process your personal data (e.g., name, email, address, phone number) in accordance with our Privacy Policy (available on the Website) and the Personal Data Protection Act 2012 (PDPA).

9.2. Personal data is used to process orders, facilitate deliveries, and provide customer support. We may also use it for marketing purposes, subject to your consent or opt-out preferences.

9.3. You can view and update your personal data in the “My Account” section of the Website.

9.4. Cookies: We use cookies to enhance your browsing experience and analyze Website usage. Cookies may collect data such as your IP address or browsing behavior. You can manage cookies via your browser settings or our cookie consent banner. For details, see our Cookie Policy on the Website.

9.5. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access.

10. Refund Policy

10.1. If a product is unavailable at the time of order fulfillment, we will contact you to offer:

  • A comparable replacement product.
  • A voucher equal to the product’s value.
  • A full refund of the product’s value.10.2. If you receive incorrect, missing, or defective Goods, notify us within 7 days of delivery at customerservice@phoonhuat.com. You may choose a replacement, a voucher, or a full refund. Refunds will be processed within 14 days of confirmation or return of the Goods.10.3. Refunds will be issued to the original payment method unless otherwise agreed.

11. Intellectual Property

11.1. All content on the Website, including text, images, logos, and software, is owned by or licensed to Le Petit Depot Pte. Ltd. and is protected by copyright, trademark, and other intellectual property laws.

11.2. You may not reproduce, distribute, or modify Website content without our prior written consent, except for personal, non-commercial use.

12. General

12.1. If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court of competent authority, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.

12.2. We may suspend or restrict access to the Website for maintenance, security, or technical reasons without prior notice.

12.3. You may not assign or transfer your rights or obligations under these Terms without our consent. We may assign our rights or obligations to a third party (e.g., in case of a business sale).

12.4. Any failure by us to enforce a provision of these Terms does not constitute a waiver of that provision.
